Consignment Terms & Conditions
In these general terms and conditions, the following definitions apply:
Cavan – Caroline Vandenhoucke: the company established at 1190 Vorst, registered with the Crossroads Bank for Enterprises under number 1033 075 536.
Consignor: the natural or legal person who offers goods to Cavan on consignment.
Consignment: the agreement whereby the Consignor transfers goods to Cavan for the purpose of selling them to third parties on behalf of the Consignor.
Buyer: a third party who purchases goods via Cavan.
Goods: the items offered for sale by the Consignor.
1. Applicability
- These terms and conditions apply to all consignment agreements between Cavan and the Consignor.
- Deviations from these terms and conditions are only valid if agreed upon in writing.
2. Offering and Acceptance of Goods
- Cavan reserves the right to refuse offered goods without stating any reason.
- Goods must be in good, saleable condition and must be the property of the Consignor.
- The Consignor declares that the offered goods are free from third-party rights and are authentic.
3. Price and Commission
- The selling price is determined in consultation with the Consignor.
- Cavan receives a commission based on the final selling price. The percentage is agreed in advance.
- Any discounts or price reductions are only applied in consultation with or after approval by the Consignor.
4. Sale and Payment
- After the sale of the goods, the proceeds, reduced by Cavan’s commission, are transferred to the Consignor within 30 days.
- If the item has not been sold within an agreed period, the item will be returned or the agreement will be revised.
- In the event of a return by the Buyer, Cavan’s return conditions apply. The Consignor will only receive payment once the sale is final. In other words, the Buyer has a 14-day right of withdrawal after purchase. Payment to the Consignor will therefore take place at the earliest 14 days after the customer has received the item. We can therefore guarantee that payment will be made within one month after the final sale.
5. Risk and Liability
- Cavan takes care of safe storage and handling of the goods but is not liable for damage, loss or theft, except in cases of gross negligence or wilful misconduct. Cavan always acts with due care and professionalism and does not use the products for its own purposes.
- The goods remain the property of the Consignor until they are sold.
6. Duration and Termination
- The duration of the consignment period is agreed in advance, with a minimum of 90 days.
- Both parties may terminate the agreement prematurely with a notice period of 7 days. The Consignor shall pay a contribution of EUR 75 per item to cover administrative and logistical costs. Upon termination, unsold goods will be returned at the expense of the Consignor.
7. Disputes and Applicable Law
- This agreement is governed by Belgian law.
- Disputes shall be submitted to the competent court in Brussels.
